法定性别（英语：Legal gender），亦称为法律性别，系指法律所认可的社会性别或者生理性别。法律性别的确定通常涉及生物性别、性别重新决定以及性别认同等因素，具体情况因司法管辖区域的不同而有所差异。法律层面的性别身份对许多法律权利与义务具有基础性作用，包括获得医疗服务、工作权利、家庭关系，以及个人身份识别和证件相关的问题。尽管其基本原则看似较为简单，但确定法律性别却极为复杂，充分彰显了生物特征、自我认同的性别认同、社会规范以及不断演变的法律标准之间的动态交互作用。鉴于此，法律性别研究属于一个复杂的领域，受到文化、历史以及法律等诸多因素的影响。故而，有必要展开全面深入的探讨，以便充分理解该主题在一系列法律体系以及社会中的影响和范畴。

历史

在欧洲社会中，罗马法、后古典时期的教会法以及后来的普通法将人的性别划分为男性、女性或雌雄同体。其拥有法律权利则根据外表上最为显著的性别特征确定为男性或女性。根据罗马法，雌雄同体必须被归类为男性或女性。[2]12 世纪的《格拉提安教令集》规定：“雌雄同体的人作为遗嘱见证人，取决于哪一种性别占优势。”[3][4][5]作为普通法的基础，16 世纪的《英格兰法律原理》描述了雌雄同体可根据“占优势的性别”继承财产，无论是以男性还是女性的身份。[6][7]几个世纪以来，曾经有法律案件涉及法律性别的疑义而被记载下来。

1930 年，莉莉·艾尔伯接受了性别重置手术及卵巢移植，并将她的法定性别改为女性 。 1931年，朵拉·里希特接受了阴茎切除术和阴道成形术。数周后，莉莉·艾尔伯进行了最终手术，包括子宫移植和阴道成形术。然而，因移植的子宫引发的免疫排斥反应，致使她不幸离世。1933 年 5 月，性学研究所遭到纳粹袭击，关于里希特的任何现存记录均被损毁。[来源请求]
